These Terms of Service ("Agreement") govern access to and use of Communify Solutions (the "Platform," "Service," or "Software"), a business-management application used by trade and service businesses (each an "Organization") to manage contacts, jobs, communications, advertising, and related operations. "Company," "we," "us," or "our" refers to the operator of the Platform; "you" refers to the individual or Organization accessing or using the Platform.
By creating an account, joining an Organization, or otherwise accessing or using the Platform, you agree to be bound by this Agreement. If you do not agree to these terms, do not access or use the Platform.
The Platform is organized around Organizations — each Organization's contacts, jobs, communications, and other business data are isolated from other Organizations. You are responsible for the accuracy of information you provide and for activity that occurs under your account. An Organization's administrators are responsible for managing who has access to that Organization's data.
Company grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your Organization's internal business purposes. This Agreement does not grant you any ownership interest in the Platform or its underlying code, design, or infrastructure.
Access to the Platform, and certain features within it, may require payment of fees disclosed to you at the time of purchase (for example, a one-time account activation fee or a paid add-on feature). Payments are processed by Stripe; use of Stripe is subject to Stripe's own terms. Fees are non-refundable except as required by law or as we otherwise state in writing. We may offer promotional or discount codes at our discretion; misuse of a promotional code may result in the associated access being revoked.
The Platform integrates with a number of third-party services to operate, each governed by its own terms and privacy policy, independent of this Agreement:
Where a connected service (for example, Meta) provides its own platform terms — such as the Meta Platform Terms and Developer Policies — your use of that integration is also subject to those terms.
As between you and Company, your Organization retains ownership of the business data you submit to the Platform (contacts, job records, communications, and similar). You grant Company a license to host, process, and transmit that data solely as needed to provide the Platform's features to your Organization. See our Privacy Policy for how information is collected and used, and the data-deletion information below for how connected-account data is removed.
You may request deletion of your Organization's data at any time by contacting us at the address below. If you connect a Meta (Facebook/Instagram) account to the Platform and later remove the Platform's access from your Facebook settings, Meta notifies us automatically and we delete the associated connection data without requiring a separate request.
You agree not to:
The Platform, including all software, design, and content (excluding your Organization's own business data and any third-party data obtained through a connected service), is the property of Company. This Agreement does not transfer any ownership rights to you.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM, AND COMPANY'S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE PLATFORM SHALL NOT EXCEED THE FEES YOU PAID TO COMPANY IN THE 12 MONTHS PRECEDING THE CLAIM.
Company may suspend or terminate your access to the Platform at any time, with or without cause, including for violation of this Agreement. Upon termination, your license to use the Platform ends immediately; your Organization's data is handled as described in Section 7.
Company may update this Agreement from time to time. Continued use of the Platform after changes take effect constitutes acceptance of the revised Agreement.
This Agreement is governed by the laws of the State of Florida, without regard to its conflict of laws principles.
